An automatic confirmation does not in itself necessarily constitute acceptance of the order; the contract is formed upon the Service Provider’s declaration of acceptance.

In the case of bespoke deliveries of paintings, the Service Provider shall accept the order once the delivery terms have been agreed. If no agreement is reached on the terms of the bespoke delivery, the Service Provider shall not be obliged to commence fulfilment of the order and shall settle the purchase price already paid in accordance with the law.

In the case of products requiring special delivery or packaging, the delivery time may vary; the Customer will be duly informed of this.

The Customer must provide the correct email address required for access.

It is the Customer’s responsibility to ensure that the technical requirements for using the digital product – in particular, a suitable device, software and internet connection – are met.

17. Right of withdrawal for physical goods

The consumer is entitled to a 14-day right of withdrawal without giving any reason, provided that the conditions set out in the legislation are met.

In the case of a physical product, the time limit is, as a general rule, calculated from the date of receipt of the product. In the case of multiple products or deliveries made at different times, the specific rules laid down in the relevant legislation apply.

The Customer may also indicate their intention to withdraw from the contract by using the online withdrawal function available under the „Withdrawal from the contract” menu item on the Website.

In the event of a valid withdrawal, the Service Provider shall refund the amount paid by the consumer in accordance with the relevant legislation.

As a general rule, the direct costs of returning the product are borne by the consumer, unless otherwise provided for by law or by the Service Provider.

The consumer is liable for any reduction in the value of the product if they have used it beyond what is necessary to assess it for the purposes of exercising their right of withdrawal.

18. Exceptions to the right of withdrawal

The consumer’s right of withdrawal may not be exercised in the cases specified in the relevant legislation.

This could include, in particular:

  • a product manufactured in accordance with the consumer’s instructions or at their express request, or a product made to their specifications;
  • digital content supplied on a non-tangible medium, where the performance of the contract has begun with the consumer’s express prior consent and the consumer has acknowledged the loss of the right of withdrawal;
  • a leisure service available at a specific time or for a specific period.

The Customer may familiarise themselves with the cancellation terms and conditions relating to the specific product or service before making a purchase.

19. Digital products and the loss of the right of withdrawal

The Service Provider shall only commence the supply of the digital product before the expiry of the 14-day withdrawal period with the consumer’s express prior consent.

When purchasing a digital product, a separate statement appears for the Customer:

„I request immediate delivery of the digital product, and I acknowledge that by doing so I forfeit my 14-day right of withdrawal.”

Accordingly, the Service Provider will only grant access to the digital content once the necessary consent has been given.

Confirmation of the consent and the information regarding the loss of the right of withdrawal will also be provided electronically.

20th PszichoSzalon: electronic tickets

Electronic tickets are available for PszichoSzalon events.

The ticket will be sent electronically to the email address provided by the Customer and may include, amongst other things, the name, date, venue and the identification number or QR code required for entry.

A PszichoSzalon ticket valid for a specific date or period relates to a leisure service; therefore, in accordance with the law, the consumer is generally not entitled to the 14-day right of withdrawal without giving a reason.

The terms and conditions governing the transfer or resale of tickets may be set out in the information relating to the event in question.

In the event that an event is cancelled or rescheduled, the Service Provider shall inform the Customers concerned and shall act in accordance with the relevant legislation and the terms and conditions applicable to the event in question.

21. Photographs and video recordings at events

Photographs and video recordings may be taken at PszichoSzalon events for documentation and communication purposes.

The footage consists primarily of general shots of the event and its atmosphere, showing the event as a whole, the venue, the speaker or performer, the stage, the audience, the atmosphere of the event, and any programmes associated with it.

The recordings may be published, in particular, on the PszichoPaletta website, on its social media platforms and video-sharing channels, as well as in the communications and promotional materials of PszichoSzalon and PszichoPaletta.

When filming, we endeavour to ensure that participants are not portrayed as individual protagonists, but as part of the event as a whole.

If we wish to feature a participant individually and prominently – for example, in a portrait photograph, an interview, a separate video recording or personalised marketing content – we will seek the data subject’s separate, explicit consent for this. Such individual consent is not part of general admission to the event.

Participants will be provided with appropriate information regarding photography and filming when purchasing tickets and at the venue; we will clearly indicate that photographs and video recordings are being taken.

Detailed information on data protection relating to the processing of photographs and video recordings is set out in PszichoPaletta’s Data Protection Notice.

22. Warranty for defects and guarantee

The Service Provider shall be liable for defective performance in accordance with the rules on the warranty of quality set out in the Civil Code and other relevant legislation.

In the event of defective performance, the consumer may exercise the rights set out in the relevant legislation.

A consumer may not make a claim for defective performance on the grounds of a defect of which they were aware at the time the contract was concluded or of which they ought to have been aware.

The characteristics inherent in the unique, hand-crafted nature of the paintings do not in themselves constitute a failure to perform.

Any discrepancy between the colours displayed on a screen, monitor or other technical device and the actual colours of the painting, arising from the technical display, does not in itself constitute a breach of contract.

The Service Provider applies the statutory provisions relating to the statutory warranty to those products for which it is required to do so.
